WeRemidy Terms of Service

Thank you for using WeRemidy! WeRemidy is created by Cornelis Vermeer, trading as WeRemidy, a sole trader established in Ireland ("we," "us," "Cornelis"). These Terms of Service ("TOS") govern the use of WeRemidy online at weremidy.com and on mobile devices (collectively, "WeRemidy").

These TOS represent a binding contract between you and us. By creating an account, logging in, or otherwise accessing or using WeRemidy, you expressly agree to be bound by the TOS.

The TOS incorporate the provisions of our Privacy Policy, so please review that carefully too. These TOS are subject to change as described in Section 11(d). If you do not agree to the TOS, you have no right to access or use WeRemidy and must immediately stop using it.

1. Your Account Information and Email

WeRemidy provides text and interactive content intended to be used by responsible adults, to inspire and offer insight. When you create an account, we require you to provide information about yourself, including an email address where we can contact you. This need not be your primary email address — just one where you can receive necessary account and service-related emails.

Some WeRemidy features, now or in future, may allow you to post or submit content and materials for publication on WeRemidy ("Your Content"). You own any intellectual property rights to Your Content, but you agree that we can use, reproduce, modify, adapt and publish Your Content for the purpose of enabling us to offer WeRemidy or the features you have chosen to use. You are responsible for Your Content, and acknowledge that once published, we cannot always remove it.

By submitting reviews, ratings, testimonials, or feedback about WeRemidy, you grant us the right to use, reproduce, modify, and display your submissions in our marketing materials, on our website, in social media, and in advertising. We may include your first name, last initial, and general location alongside your review. You represent that your submissions are accurate, do not violate any third party's rights, and are not defamatory or unlawful.

By creating an account, you consent to receive electronic communications from us, including account notifications and, where you've opted in, promotional messages. You may opt out of promotional messages using the unsubscribe link at the bottom of our emails, but you may not opt out of transactional communications necessary for your account, such as password reset emails or important service notices.

2. Adults Only

The text and interactive content on WeRemidy is intended for responsible adults, to inspire and offer insight. You must be at least 18 years of age to use this site.

By using WeRemidy, you certify that:

Certain features of WeRemidy ("Level 3") require you to verify your age by uploading a government-issued ID document, which we review manually before granting access — see our Privacy Policy for details on how that document is handled.

Neither WeRemidy nor its affiliates will be responsible for any legal consequences arising from a false certification or fraudulent use of this site. By viewing and using WeRemidy, you agree that you and any business entity in which you hold a legal or equitable interest submit to the personal jurisdiction of the courts of Ireland for any dispute arising between you and us, subject to Section 11(c) below.

3. Intellectual Property

WeRemidy is protected by Irish and international intellectual property law, and you agree to abide by it. Without our prior written consent, you may not download, copy or store WeRemidy content outside of WeRemidy, and you may not modify, publish, transmit, transfer, sell, reproduce, create derivative works from, distribute, or perform any WeRemidy content. You agree that all text, data and algorithms on our site and associated servers are trade secrets, without limitation. You agree to comply with reasonable written requests from us to help protect our proprietary and intellectual property rights in WeRemidy. As between you and us, all intellectual property rights in WeRemidy are our sole and exclusive property.

You may not use the content on WeRemidy for the development of any software program, including training a machine learning or artificial intelligence system. You may not copy, harvest, crawl, index, scrape, spider, mine, gather, extract, compile, obtain, aggregate, capture, access, store, or republish any content for data mining, or for the training, development, testing, fine-tuning, improvement, grounding (including via RAG), or operation of any large language model, foundation model, deep machine learning system, generative AI, or similar software or service.

We appreciate feedback you provide through customer service, email, or social features, but we may use any feedback, comments, or suggestions without any obligation to you.

4. Your License to Use WeRemidy

We grant you a limited, non-exclusive, non-sublicenseable, non-transferable, revocable licence to access WeRemidy for personal, non-commercial use only, subject to these TOS. This licence lasts as long as you are not barred from WeRemidy by applicable law and your account has not been terminated by you or us. If these TOS are not enforceable where you are located, you may not use WeRemidy. We reserve all right, title, and interest not expressly granted under this licence.

5. Restrictions and Prohibited Uses

WeRemidy exists to inspire and support our users, and we're proud of the trust our users place in us. We expect, in turn, that you won't misuse our service. Except with our written permission, you shall not:

Prohibited use is grounds for immediate termination of your account and may expose you to civil or criminal liability.

6. Disclaimers

WeRemidy is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We aim to maintain WeRemidy on a commercially reasonable basis but cannot guarantee uninterrupted or error-free access at all times.

WeRemidy is not a medical service and must not be used to seek medical treatment or advice. WeRemidy does not provide medical advice, diagnosis, or treatment. Its content, including the in-app AI coach, is for informational and educational purposes only. Always consult your physician or another qualified health provider with questions about a medical condition or sexual health concern, and never disregard or delay seeking professional medical advice because of something you have seen on WeRemidy.

Nothing in these TOS excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for death or personal injury caused by our negligence, or any statutory rights you have as a consumer under Irish or EU law that cannot be waived by agreement. Subject to that, some jurisdictions do not allow the disclaimers in this section, so they may not fully apply to you.

7. Limitation of Liability

To the fullest extent permitted by law, and subject to the savings clause in Section 6 above, we will not be liable for: (i) lost profits, lost data, or failure to meet any duty (including good faith and reasonable care) arising from your access to or use of WeRemidy; or (ii) any indirect, incidental, punitive, special, exemplary, or consequential damages of any kind.

Our aggregate liability to you for all claims arising out of or relating to your use of, or inability to use, WeRemidy, whether in contract, tort, or otherwise, is limited to €100.

This limitation reflects a reasonable allocation of risk and is a fundamental part of the basis of our agreement with you; WeRemidy would not be offered without it. As noted in Section 6, this section does not limit liability that cannot be excluded under applicable law, and some jurisdictions do not allow limitations of this kind, so they may not fully apply to you.

8. Reporting Copyright Infringement or Illegal Content

If you believe material on WeRemidy infringes your copyright or other intellectual property rights, or is otherwise illegal content, please contact us at hello@weremidy.com. As a hosting service accessible in the EU, we handle such reports in line with the EU Digital Services Act's notice-and-action mechanism and Irish copyright law (Copyright and Related Rights Act 2000).

Please include in your notice:

We will assess valid notices and take appropriate action, which may include removing or disabling access to the reported material and notifying the person who posted it.

9. Indemnity

You will indemnify and hold us harmless, including for reasonable costs and legal fees, from any third-party claim arising from your access to WeRemidy, Your Content, or your violation of these TOS.

Release. To the extent permitted by law and subject to Section 6 and Section 7, you agree that we will not have liability to you under any theory in connection with your use of WeRemidy beyond what is set out in Section 7, and you release us from claims arising from your use of WeRemidy, subject to the same limitations.

Notices. We may give you notice under these TOS or any other published policy by email or by a general notice on WeRemidy. We will never ask you for personally identifiable information, and specifically never your payment card details, via email or post. If you receive a message purporting to be from us asking for this information, please do not respond. You may give us notice by email at hello@weremidy.com or by post to:

10. Dispute Resolution

Informal resolution first. If you have a dispute with us, please contact us first at hello@weremidy.com with a description of the issue. We will try to resolve it informally and in good faith within 60 days.

Your right to go to court. If we can't resolve a dispute informally, you're free to bring proceedings in the courts described in Section 11(c). Nothing in these TOS requires you to use arbitration, and nothing here waives your right to a court hearing or, where applicable under EU law, your right to bring a claim as part of a collective consumer action.

Consumer complaints. If you are a consumer, you may also be able to raise a complaint with a national alternative dispute resolution (ADR) body or consumer protection authority in your country of residence — in Ireland, this is the Competition and Consumer Protection Commission (www.ccpc.ie). (Note: the EU's centralised Online Dispute Resolution platform was permanently discontinued on 20 July 2025 and is no longer available.)

11. General

(a) International Use. WeRemidy is operated from and hosted within the EU. If you access WeRemidy from outside the EU, you do so at your own risk and are responsible for complying with your local laws. You may not access WeRemidy from any country or territory where such access is illegal, banned, or restricted, including sanctioned countries or territories, and you represent that you are not located in, or a national or resident of, any such country or territory. You agree to comply with applicable export and import control laws.

(b) Severability and Waiver. If any part of these TOS is held invalid or unenforceable, the remaining provisions remain in full effect, and an enforceable term will be substituted that reflects the parties' intent as closely as possible. Either party's failure to enforce any term is not a waiver of the right to do so later.

(c) Governing Law and Venue. These TOS are governed by the laws of Ireland. Subject to the paragraph below, you and we agree that the courts of Ireland have exclusive jurisdiction over any dispute relating to these TOS, and both parties consent to that jurisdiction and waive objections based on inconvenient forum or venue.

If you are a consumer habitually resident in the EU/EEA, nothing in these TOS deprives you of the protection of the mandatory consumer-protection laws of your country of residence, and you may bring proceedings before the courts of your own country of residence, in line with the EU Brussels I (recast) and Rome I Regulations.

(d) Change Policy. We may update these TOS from time to time to reflect changes in the law or to our services. We will post updated terms on our website at least 30 days before they take effect. If we make material changes, we will also notify you at the email linked to your account, or through other reasonable means, before the changes take effect — except for changes required by law or relating to new services, which may take effect immediately. Unless applicable law says otherwise, your continued use of WeRemidy after the effective date means you accept the updated TOS. If you don't agree with an update, you should stop using WeRemidy before it takes effect; you're always free to close your account at any time.

(e) Force Majeure. We won't be liable for any failure, delay, or unavailability of WeRemidy, or for any failure to comply with these TOS, arising from a cause beyond our reasonable control.

(f) Miscellaneous. These TOS are the complete and exclusive statement of the understanding between you and us, and supersede all prior written and oral agreements on this subject. If there's a conflict between these TOS and any other posted terms, these TOS govern unless stated otherwise. Sections 2–11 survive termination of these TOS.
